New Law Prevents Companies From Charging to Remove, Modify, or Correct Booking Photos

On January 1, 2015, Senate Bill 1027 went into effect, and the new law will prohibit any person, company, or business entity from charging individuals to remove, modify, or correct booking photographs.

Prior to Senate Bill 1027, which will be codified as Civil Code section 1798.91.1, companies frequently would charge people to remove their booking photos from a website. However, what those people did not know is these companies operated multiple websites and charged a different fee to remove the booking photo from each website. Senate Bill 1027 makes it illegal for these companies to continue with this abhorrent practice.

If a company, business entity, or person violates the new law, then they can be subjected to $1000 in civil damages each time they violate the law. Further, a person can recover actual damages if they are greater, and the law also allows a person to recover attorney
